Informujemy naszych Klientów, że Dariusz Mierzwa ART Graficom wdrożył Procedury i Politykę bezpieczeństwa zgodną z RODO

Zgodnie z Ustawą o Ochronie Danych Osobowych Dz. U. z dnia 10.05.2018 poz. 1000; z art. 13 ust. 1 i 2 ogólnego Rozporządzenia o Ochronie Danych Osobowych z dnia 27 kwietnia 2016 r. (rozporządzenie Parlamentu Europejskiego i Rady UE 2016/679 w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE) oraz ustawy z dnia 4 maja 2019 Dz.U.2019 poz.730 uprzejmie informujemy, że:

1. TOŻSAMOŚĆ ADMINISTRATORA– Administratorem Pani/Pana danych osobowych jest Dariusz Mierzwa Graficom, mający siedzibę w Chorzowie, ul. Bożogrobców 3.

2. DANE KONTAKTOWE ADMINISTRATORA– Z administratorem danych można się skontaktować poprzez adres e-mail: d.mierzwa@graficom.pl lub telefon +48 601716403 lub pisemnie na adres siedziby administratora.

3. DANE KONTAKTOWE INSPEKTORA OCHRONY DANYCH– Administrator wyznaczył Inspektora Ochrony Danych. Z inspektorem ochrony danych można się kontaktować we wszystkich sprawach dotyczących przetwarzania danych osobowych oraz korzystania z praw związanych z przetwarzaniem danych. 4. CELE PRZETWARZANIA I PODSTAWA PRAWNA

Pani / Pana dane będą przetwarzane w celu obsługi świadczonych usług rozwijanych i utrzymywanych przez administratora. Podstawą prawną przetwarzania Pani/Pana danych jest niezbędność do wypełnienia obowiązków prawnych ciążących na administratorze wynikających z przepisów prawnych regulujących funkcjonowanie i wykonywanie szczególnych zadań zgodnie z obowiązującym prawem. Przetwarzanie danych osobowych jest warunkiem koniecznym do realizacji działań gospodarczych, teleinformatycznych i informacyjnych w Graficom podstawę do przetwarzania danych stanowi art. 6 (pkt c-f) Rozporządzenia Parlamentu Europejskiego i Rady UE 2016/679. 

5. OKRES PRZECHOWYWANIA DANYCHDane będą przetwarzane przez okres niezbędny dla zapewnienia ciągłości funkcjonowania systemów informatycznych. Okres przetwarzania jest niezbędny dla celów wynikających z prawnie uzasadnionych interesów realizowanych przez administratora. 

6. ZAKRES PRZETWARZANIA DANYCH– Dane osobowe mogą być udostępniane innym podmiotom, uprawnionym do ich otrzymania na podstawie obowiązujących przepisów prawa, a ponadto odbiorcom danych w rozumieniu przepisów o ochronie danych osobowym, a w szczególności Sądom, Prokuraturze, Policji, Służbom Specjalnym oraz podmiotom świadczącym usługi pocztowe, kurierskie oraz podmiotom współpracującym z Graficom na podstawie umów powierzenia.

7. PORTALE SPOŁECZNOŚCIOWE– Dane mogą być przetwarzane przez administratorów portali społecznościowych jak Facebook, Instagram, Twitter, Pinterest, Linkendin, etc. po wykonaniu czynności „lubię to”, lub wybraniu funkcji „udostępnij”

8. PRAWA PODMIOTÓW DANYCH– Dane osobowe będą przetwarzane, w tym przechowywane zgodnie z przepisami ustawy z dnia 14 lipca 1983 r. o narodowym zasobie archiwalnym i archiwach (Dz. U. z 2018 r., poz. 217 ze zm.), a w przypadku przetwarzania danych na podstawie wyrażonej zgody, przez okres niezbędny do realizacji wskazanego celu. W związku z przetwarzaniem danych osobowych, na podstawie przepisów prawa, posiada Pani/Pan prawo do: 

a) dostępu do treści swoich danych, na podstawie art.15 ogólnego rozporządzenia;

b) sprostowania danych, na podstawie art.16 ogólnego rozporządzenia.

Podczas przetwarzania danych na podstawie wyrażonej zgody posiada Pani/Pan prawo do:

a) dostępu do treści swoich danych, na podstawie art.15 ogólnego rozporządzenia;

b) sprostowania danych, na podstawie art. 16 ogólnego rozporządzenia;

c) usunięcia danych, na podstawie art. 17 ogólnego rozporządzenia;

d) ograniczenia przetwarzania, na podstawie art. 18 ogólnego rozporządzenia;

e) wniesienia sprzeciwu, na podstawie art. 21 ogólnego rozporządzenia.

Prawa te są wykonywane przez Panią/Pana również względem tych osób, w stosunku do których sprawowana jest prawna opieka. 

9. PRAWO DO OGRANICZENIA i ZAPRZESTANIA PRZETWARZANIA– W przypadku, w którym przetwarzanie danych odbywa się na podstawie wyrażonej zgody, przysługuje Pani/Panu prawo do jej cofnięcia, w dowolnym momencie, w formie, w jakiej została ona wyrażona. Od tego momentu Pani/Pana dane nie będą przez nas przetwarzane. Przetwarzanie Pani/Pana danych może zostać ograniczone, z wyjątkiem ważnych względów interesu publicznego RP lub Unii Europejskiej. Dane osobowe mogą być również przekazywane do państw trzecich, na podstawie szczególnych regulacji prawnych, w tym umów międzynarodowych.

10. INFORMACJA O DOWOLNOŚCI LUB OBOWIĄZKU PODANIA DANYCH– Gdy podanie danych osobowych wynika z przepisów prawa, jest Pani/Pan zobowiązana(y) do ich podania. Brak podania danych uniemożliwia udzielenia informacji, realizacji zgłoszenia lub obowiązku informacyjnego.

11. PRAWO WNIESIENIA SKARGI DO ORGANU NADZORCZEGO– Ma Pani/Pan prawo wniesienia skargi do organu nadzorczego – Prezesa Urzędu Ochrony Danych Osobowych, gdy uzna Pani/Pan, iż przetwarzanie danych osobowych narusza przepisy o ochronie danych osobowych. Dokładne informacje o celach i podstawach prawnych przetwarzania danych osobowych są dostępne w Instrukcji bezpieczeństwa przetwarzania danych osobowych w Graficom oraz w Instrukcji zarządzania systemem informatycznym służącym do przetwarzania danych osobowych wraz z Instrukcją postępowania w sytuacji naruszenia systemu ochrony danych osobowych. 

We would like to inform our Clients that Graficom has implemented Procedures and Security Policies in compliance with RODO and in accordance with the Act on Personal Data Protection Dz.U. dated 10.05.2018, item 1000; with Article 13(1) and (2) of the General Regulation on Personal Data Protection dated 27 April 2016. (Regulation of the European Parliament and of the Council of the EU 2016/679 on the protection of natural persons with regard to the processing of data and on the free movement of such data and repealing Directive 95/46/EC) and the Act of May 4, 2019 Journal of Laws 2019 item 730 we kindly inform you that:

1. ADMINISTRATOR’S IDENTITY- The administrator of your personal data is Dariusz Mierzwa Graficom, based in Chorzów, Bożogrobców 3 Street.

3. DATA PROTECTION INSPECTOR CONTACT DETAILS – The Administrator has appointed a Data Protection Officer. The Data Protection Officer can be contacted in all matters concerning the processing of personal data and the exercise of rights related to data processing. 4. PROCESSING PURPOSES AND LEGAL BASIS

Your data will be processed in order to provide the services developed and maintained by the administrator. The legal basis for the processing of your / your data is the necessity to fulfill legal obligations incumbent on the controller resulting from legal provisions governing the operation and performance of specific tasks under the applicable law. The processing of personal data is a necessary condition for the performance of business, ICT and information activities at Graficom the basis for data processing is Article 6 (point c-f) of the Regulation of the European Parliament and of the Council of the EU 2016/679.

5 DURATION OF DATA STORAGEData will be processed for the period necessary to ensure the continuity of IT systems. The processing period is necessary for the purposes arising from the legitimate interests pursued by the controller.

6) SCOPE OF DATA PROCESSING – Personal data may be disclosed to other entities entitled to receive them under applicable laws, and in addition to data recipients within the meaning of the data protection legislation, in particular the Courts, the Prosecutor’s Office, the Police, Special Services and entities providing postal and courier services, as well as entities cooperating with Graficom on the basis of contracts of entrustment.

7. SOCIAL NETWORKS – Data may be processed by administrators of social networking sites such as Facebook, Instagram, Tweeter, Pinterest, Linkendin, etc. after performing the action „like”, or select the function „share”.

8. DATA RIGHTS- Personal data will be processed, including stored in accordance with the provisions of the Act of 14 July 1983 on the national archival resource and archives (Journal of Laws of 2018, item 217 as amended), and in the case of data processing on the basis of expressed consent, for the period necessary to achieve the indicated purpose. In relation to the processing of personal data, under the provisions of the law, you have the right to:

(a) access to the content of your data, pursuant to Article 15 of the General Regulation;

b) the right to rectification of data pursuant to Article 16 of the General Regulation.

When processing data on the basis of your consent, you have the right to:

(a) access to the content of your data, pursuant to Article 15 of the General Regulation;

(b) the right to rectification of data pursuant to Article 16 of the General Regulation;

(c) the erasure of data pursuant to Article 17 of the General Regulation;

(d) the restriction of processing pursuant to Article 18 of the general Regulation

(e) to object, pursuant to Article 21 of the general Regulation.

These rights shall also be exercised by you in relation to those persons for whom legal custody is exercised.

9 RIGHT TO LIMIT AND STOP PROCESSING- In the event that the processing is based on your consent, you have the right to revoke your consent, at any time, in the form in which it was given. As of this moment, your data will not be processed by us. The processing of your data may be restricted, except for important reasons of public interest of the Republic of Poland or the European Union. Personal data may also be transferred to third countries under specific legal regulations, including international agreements.

10. INFORMATION ON THE FREEDOM OR OBLIGATION TO PROVIDE DATA – If the provision of personal data results from legal regulations, you are obliged to provide them. Failure to provide data prevents the provision of information, the fulfilment of the application or the fulfilment of the information obligation

11. RIGHT TO COMPLAINT TO THE SUPERVISORY AUTHORITY – You have the right to lodge a complaint to the supervisory authority – the President of the Office for Personal Data Protection, if you consider that the processing of personal data violates the regulations on personal data protection.
